Q: What is the definition of negligence?

Negligence occurs when an individual fails to exercise the care that a reasonable person would exercise in similar circumstances. If a person fails to act as a reasonable person would, he or she may be held liable for any resulting damages.

Q: Do you handle cases outside of Texas?

A: Yes. We have the resources available, including charter aircraft, to travel throughout the United States on short notice to investigate potential claims.

Q: How much does it cost to retain the services of Hossley & Embry?

A: At Hossley & Embry, we generally operate on a contingent fee basis, which means that we will only collect our fee if your case is successful. A contingent fee structure enables us to advance any expenses and costs necessary to pursue your claim.

Once a recovery is made in your case, attorney’s fees and case expenses are deducted and then you will receive the balance of the award or settlement. We accept a fixed percentage of the funds that we recover — typically one-third of the final sum.
